(Department of History of Law)

When the legal orders valid in various societies throughout history are analyzed, it will be seen that they exhibit partly common features and partly unique characteristics. On the one hand, the history of law concerns humanity in general; on the other hand, in addition to this generality, it is of particular concern to societies that have experienced a particular legal practice. Thus, the Turkish History of Law deals with these general features of law on the one hand, and with the Turkish-specific features of law on the other. Therefore, this course aims to provide students with a perspective on the nature of law and the development of legal norms on the one hand, and on the other hand, to provide information about the development of Turkish law, especially the Ottoman experience.

In this framework, in our courses, firstly, pre-Islamic Turkish law and the definition and evidences of fiqh, which is the theoretical basis of post-Islamic Turkish law, are taught; then, subjects such as constitutional law, criminal law, personal and family law, law of obligations and law of property are analyzed by taking the principles of fiqh and Ottoman practice into account.
